The High Court on Friday suspended the arrest warrant issued against Machakos Governor Alfred Mutua.
Judge J.A Makau in his ruling said that the order by Senate Public Accounts Committee was infringing into Mutua’s constitutional rights.
PAC through the leadership of Homabay Senator Moses Kajwang, issued the Order after Mutua failed to appear before the committee.

During the aborted sitting Senator Kajwang revealed that the Parliamentary Powers and Privileges Act grants the committee of both Houses of Parliament the power to order the arrest of any witness, who severally snubs invites and summons.
“Where a summoned witness does not appear, or appears but fails to satisfy the relevant House of Parliament or committee, the relevant House or committee may order the arrest of a person who fails to honour a summons,” the Act states.
