DK Kwenye Beat risks 15-year jail term
DK Kwenye Beat risks 15-year jail term should the allegation against him be successfully proven in a court of law.
A 20-year old Nakuru based lady has come out to explain of how she was sexually exploited by DK Kwenye Beat and eventually infected with STI, a move that she alleges was intentional.
DK Kwenye Beat has since come out to accept the allegations and stated that he did that back in time before he got to know Christ and that now he is a changed man.
After the STI contraction, the lady says that she contacted Human Papilomavirus and Herpes where she spent Ksh 25,000 for treatment.
According to the lady, DK knew that he was an STD carrier when he went on her without protection and that is the exact point that the law comes in against DK (if at all it can be proven so).
Kenyan law stipulates capital punishment for individuals, who knowingly infect their partners with STDs, and most notably HIV.
Section 26(1) (c) of Kenya’s Sexual Offences Act says: “Any person who, having actual knowledge that he or she is infected with HIV or any other life threatening sexually transmitted disease intentionally infects another person with any sexually transmitted disease, shall be guilty of an offence, whether or not he or she is married to that other person, and shall be liable upon conviction to imprisonment for a term of not less than fifteen years but which may be for life.”
Section 26(2) of Kenya’s Sexual Offences Act says: “Notwithstanding the provisions of any other law, where a person is charged with committing an offence under this section, the court may direct that an appropriate sample or samples be taken from the accused person, at such place and subject to such conditions as the court may direct, for the purpose of ascertaining whether or not he or she is infected with HIV or any other life threatening sexually transmitted disease.”
We can’t tell at the moment if the lady will follow the legal way and pursue a case against DK Kwenye Beat.
